Terms of service for Commissions
Commission Agreement
By commissioning Ellabel Art Ltd, the client agrees to the terms and conditions outlined herein.
Artwork Description The client shall provide a clear and detailed description of the artwork they wish to commission, including size, style, and any specific details or reference images.
Deposit
A non-refundable deposit of 50% of the total commission price is required before work will commence. This deposit is to secure the artist's time and commitment.
Pricing
The total price for the commission will be determined based on factors including size, complexity, and time required. The client will be provided with a final quote before work begins.
Payment
Payment can be made through PayPal or bank transfer. Full payment is due upon completion of the artwork.
Timeline
The estimated completion time for the commission will be provided to the client before work begins. This timeframe may vary depending on the complexity of the artwork but will be communicated to the client in advance.
Revisions
The client is entitled to 1-3 minor revisions to the artwork during the creation process depending on the illustration. Major changes or additional revisions may incur extra charges.
Ownership and Copyright
The artist retains the copyright and ownership of the artwork, except for specific commercial rights granted to the client if applicable. The client may not reproduce, sell, or distribute the artwork without the artist's explicit permission.
Confidentiality
The artist agrees not to share any personal or sensitive information provided by the client. The client also agrees not to disclose any proprietary techniques or processes used by the artist.
Cancellation
In the event of a cancellation by the client after work has commenced, the deposit is non-refundable, and the artist may retain the artwork or offer it for sale to other parties.
Delays
The artist will make every effort to complete the artwork within the agreed-upon timeframe. However, delays may occur due to unforeseen circumstances, in which case the client will be notified.
Shipping and Handling
If the artwork is a physical piece, the cost of shipping and handling will be borne by the client and added to the final invoice.
Liability
The artist is not liable for any damages or losses incurred during shipping. The client should opt for appropriate insurance coverage if desired.
Dispute Resolution
In the event of a dispute, both parties agree to attempt to resolve it amicably through negotiation. If a resolution cannot be reached, legal action may be pursued.
Governing Law
This agreement shall be governed by and construed in accordance with the laws of England and Wales.
